DraftKings Legal States

What Is DraftKings?
DraftKings is a U.S.-based digital sports-entertainment and gaming company, founded in 2012 and headquartered in Boston. Originally built around Daily Fantasy Sports (DFS), the platform allowed users to build fantasy lineups and compete for cash prizes. As legal sports betting expanded in the United States following the 2018 Supreme Court decision in Murphy v. NCAA, DraftKings expanded into online sports betting and retail sportsbook operations in states where state-law permits.
Because each state sets its own gambling rules — including licensing, taxation, and authorized operators — DraftKings’ availability varies widely. Some states allow mobile/online sportsbooks, others limit wagering to physical locations, and still others prohibit sportsbooks altogether. This dataset focuses on the sportsbook legality of DraftKings in each state, not the separate DFS product.
When reading the status categories, keep in mind:
- Online Legal means mobile/desktop sportsbook access is permitted.
- Retail Only means betting is allowed, but only in person.
- Not Permitted means DraftKings sportsbook is not authorized under current state law.
This distinction is important because even where sports betting is legal, DraftKings must still obtain a license and meet local regulatory requirements before offering its service. Understanding these categories helps readers grasp where DraftKings can operate, how access varies, and what barriers remain.

Key Findings
- Many large states such as California, Florida, and Texas remain on the “Illegal / Not Permitted” list for DraftKings sportsbook operation, meaning significant population markets are still closed off.
- A considerable number of states classify DraftKings sportsbook as “Online Legal,” showing mobile/desktop access is becoming standard first rather than in-person only.
- “Retail Only” statuses are relatively scarce in the data, indicating most markets opt either for full online access or full prohibition — intermediate models are less common.
- States in the Northeast and Midwest tend to permit DraftKings sportsbook access earlier and more comprehensively, illustrating a regional trend toward earlier adoption of sports wagering regulation.
- Regulatory and tribal-compact complexities are key barriers: even if sports betting is legal in a state, DraftKings may still not launch if licensing, tax rules or tribal agreements are unresolved.
- Legality does not equal immediate availability: being marked “Legal” means the framework permits DraftKings, but operational rollout (licensing, partnerships, geo-fencing) can still delay user access.
